When can a Civil Partnership be dissolved?

To obtain dissolution by court order, it is necessary to prove that your civil partnership has irretrievably broken down. Irretrievable breakdown can be established by providing one of the four grounds for dissolution:

  • Your civil partner has behaved in such a manner that you cannot reasonably be expected to live with them;
  • You and your civil partner have lived apart for a period of two years and you both agree to a dissolution;
  • Your civil partner has deserted you for a period of more than two years;
  • You have lived apart for five years or more – dissolution can then be obtained whether or not your civil partner agrees to such proceedings.

As with any relationship breakdown and divorce, on a decree of dissolution, the Court is given powers to make orders dealing with the arrangements for Residence and Contact of any children from the relationship. The Court can also make financial provision in the form of property transfer, pension, lump sum and maintenance Orders.

How long does a Civil Partnership Dissolution take?

In most circumstances obtaining dissolution of a civil partnership is simple and straightforward and can usually be settled so you and your partner do not have to attend court.

The ‘petitioner’ (the person applying for the civil partnership dissolution) will carry out the majority of the dissolution process. The other party in the process is known as the ‘respondent’.
