Michael is a partner in the Dispute Resolution department acting on behalf of finance houses and leasing companies throughout the North of England. Primarily he is involved in the enforcement of leasing and hire purchase agreements, debt and asset recovery. He advises on consumer credit regulatory/compliance issues and has many years experience in dealing with finance house litigation.
Michael has the ability to analyse his clients problems very clearly, to manage the outcome of a problem to best meet the clients expectations. He is also able to offer guidance as a clients business evolves and where necessary training tailored to meet the clients needs.
Other areas of practice include obtaining of injunctions, civil fraud and claims relating to guarantees. Michael also defends clients in respect of Health & Safety Executive prosecutions and advises on regulatory issues.
Michael’s recent work has included :
- The redrafting of a suite of commercial lending documentation to reflect the recent changes in the law relating to Consumer Credit regulations to ensure compliance and enforceability.
- The recovery of assets subject to a finance agreement where the goods were kept in a number of sites through out the UK and the hirer entered into administration.
- Successfully protecting a clients intellectual property and goodwill in the business name and trading style when it was found that other companies were trying to adopt and trade under a similar name under which they would benefit from his clients market position.
- On a daily basis, Michael is involved on the enforcement of leasing and hire purchase agreements.
