Mark is Head of Dispute Resolution. He has extensive experience in all aspects of commercial litigation and specialises in issues arising in the event of personal and corporate insolvency and business recovery, acting for insolvency practitioners, company directors or individuals as determined by the facts of each particular matter. Mark also advises Trustees in Bankruptcy and supervisors of individual voluntary arrangements.
In the commercial arena, his objective is to achieve resolution of disputes at an early stage and in the most effective manner whether by negotiation, mediation, litigation or other forms of dispute resolution. Mark’s day to day work involves advising on contractual disputes, partnership and shareholder disputes. His work also includes injunctive work to protect his client’s property, assets and to preserve third party assets whilst Court proceedings continue by the obtaining of freezing orders and search orders.
Mark has also developed a practice advising on and guiding clients through rights of way disputes and boundary issues.
Mark heads a team of lawyers delivering sharply focused advice for businesses and private clients with representation before the courts The dispute resolution department complements the legal services provided by the other departments of the firm.
Mark’s recent work includes: -
- Acting for and advising an Administrator on the restructuring and ultimate disposal through administration of a substantial motor dealership and hire company preserving not only the core of the business but also the employment of its staff.
- Working with a Trustee in Bankruptcy negotiating and successfully applying to the Court for a bankruptcy annulment thereby preserving, development land and a limited company, which would otherwise have not realised their true value.
- By negotiation, a long running shareholders disagreement was concluded prior to trial after he took over conduct of the matter from a different solicitor and established a common ground between the parties removing the animosity that was preventing any discussions taking place.
- Assisting a credit union in its debt recovery procedures and credit control following a substantial internal change and restructuring.
