Will I have to go to Court?
Generally, parties to undefended divorce proceedings will not need to attend Court in relation to the Divorce.
However, in the absence of agreement, you or your spouse can apply for the Court to settle a dispute regarding the financial issues arising from the breakdown of the marriage.
If you have to attend Court, the court will encourage you to negotiate an agreement between you and your spouse (with the advice of your Solicitor), but failing that, the Judge will make a decision.
Likewise if there is a dispute regarding the arrangements for the children which cannot be resolved by other means, you or your spouse may make an application to court to resolve this.
